Afternoon everyone,

It seems ACMA's anti-SMS spam campaign is continuing despite its recent troubles with Hyarchis.

The latest company caught in the net is a small Sydney firm called EMX. They've agreed to pay ACMA $10,000 and undertake regular audits and training to prevent further breaches from occurring. It's part of an 'enforceable undertaking' EMX has signed with the regulator.

It's no surprise there's a crackdown on the premium mobile content sector given the rise in the number of complaints brought against it in 2008.

ACMA have repeatedly said they have a number of enforcement tools available to them to punish offenders. It will be interesting to see whether the number of 'enforceable undertakings' issued this year increase compared to straight out fines or formal warnings, particularly in the wake of Hyarchis.
